Terms of Service

Effective 2026-06-01. These terms govern your use of Capio (the "Service"). By creating an account or using the API you agree to them.

1. What Capio is

Capio is a hosted proxy for large-language-model inference. You send requests to our API using an OpenAI- or Anthropic-compatible payload, we forward them to one of several upstream model providers, return the response to you, and bill your prepaid credit balance for the tokens consumed.

We do not own the underlying models. The Service adds authentication, rate limiting, automatic model selection, fallback across providers, and per-customer usage accounting. Model behaviour, content policies, and capabilities are defined by the upstream providers.

2. Your account

  • You must provide a valid email address at signup. We use it to deliver your API key and any critical account notifications.
  • You're responsible for keeping your API keys secret. Anyone with a key can spend your credits.
  • You must be at least 18 years old, or have a parent or guardian's agreement, to use the Service.
  • One account per person or organisation. We may suspend accounts that appear to be duplicates or resellers.

3. Acceptable use

You agree not to use the Service to:

  • Generate content that is illegal in your jurisdiction or the jurisdiction of the recipient.
  • Spam, harass, or harm individuals. This includes stalking, doxxing, non-consensual intimate imagery, and bulk unsolicited messages.
  • Generate malware, phishing payloads, or content designed to compromise computer systems.
  • Bypass safety guardrails of upstream providers (jailbreak prompts, prompt-injection that subverts moderation, etc.).
  • Resell the Service without written permission from us.

We may suspend or terminate accounts that violate these terms. Where feasible we'll warn you first; for clear-cut harm we may not.

4. Credits, billing, and refunds

  • The Service is prepaid. You buy a credit pack via Paddle, the pack is added to your account on confirmed payment, and tokens are deducted as you use them.
  • Credits do not expire. If you don't use them for a year, they still work.
  • Pricing is per million tokens and depends on the model you call. The current price is shown on the /models page before you send the request.
  • Refunds. Unused credits are refundable within 14 days of purchase. Email [email protected] with the email on the account. We'll process the refund through the original payment method within 10 business days.
  • Used credits (i.e. tokens already billed against your balance) are non-refundable. If an upstream provider mis-prices a model, we'll correct the catalog within 7 days and re-credit affected accounts.

5. Service availability

We aim for high availability but do not guarantee 100% uptime. The Service may be unavailable due to upstream provider outages, maintenance windows, network issues, or force majeure. We publish live status at /status.

If we breach an uptime SLA you've signed separately (an enterprise contract), the remedy is defined in that contract. Pay-as-you-go customers are not entitled to SLA credits.

6. Data and privacy

We log request metadata (tokens consumed, latency, model used, HTTP status) for billing and debugging. We do not log prompt or completion content. See our Privacy Policy for the full picture.

7. Intellectual property

You retain all rights to the prompts you send and the completions you receive. We claim no ownership over your content. Model outputs may carry upstream provider terms — check those if you're building a commercial product.

We retain rights to the Service itself: the code, the documentation, the brand. Don't copy our marketing copy or logo without asking.

8. Limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost profits, lost data, or business interruption.

Our total liability to you for any claim is capped at the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

9. Changes to these terms

We may update these terms. Material changes (anything that materially affects your rights or obligations) will be announced by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
